One type of contract dispute that arises frequently concerns multiple business owners who cannot agree on how to run their business. These types of ownership disputes (or “business divorces”) are often referred to as shareholder disputes or partnership litigation. They typically involve a written agreement (i.e., a “contract”) such as an Operating Agreement, Limited Partnership Agreement or Shareholders’ Agreement concerning how the affairs of the business are supposed to be conducted, and one owner’s claim that another owner is in breach of the agreement.
