The firm was successful in obtaining the dismissal of a complaint filed by a former employee of our client, who alleged that she had been discriminated against due to her medical condition. The employee was terminated by our client (a medical practice) for poor performance, and then filed a complaint with the Equal Employment Opportunity Commission alleging that she was discriminated against in violation of the Americans with Disabilities Act. We responded to the discrimination complaint with an aggressive and very factual presentation proving that the employee was terminated due to her performance and that her termination was in no way related to her medical condition and claimed disability, following which the EEOC closed its investigation because it determined that there was no violation of law.
