Firm Prevails On Appeal
The firm recently prevailed in the Second Department. Our client was sued by an attorney for fees, and he counter-claimed against the attorney alleging professional negligence. The lower court dismissed the counterclaim on a motion to dismiss, but the Appellate Division reversed and reinstated that malpractice counterclaim, agreeing with all of our arguments that the dismissal was incorrect. The case may now proceed to trial with our client able to claim damages from the attorney as a result of the alleged professional negligence.
