David Rubinstein is a seasoned, and tenacious litigator with over a decade of experience representing defendants and plaintiffs in complex commercial matters, including securities, real estate, government, business, bankruptcy, legal malpractice, and employment disputes. David also has significant experience representing global financial services companies, issuers, hedge funds, and individuals in connection with government, regulatory, and internal investigations.
David has substantial hands-on litigation experience representing a wide range of clients, including some of the largest financial institutions in the world, multi-national companies, investment firms, private individuals, public and privately held corporations, directors, officers, and shareholders, in a broad range of industries, including financial services, private equity, litigation funding, legal services, and insurance.
David actively manages all facets of litigations and investigations and routinely advises clients regarding how to achieve the optimum results in the most efficient and cost-effective manner. The broad scope and extent of David’s experience enables him to quickly and efficiently identify the primary issues involved in a matter as well as to develop and implement an effective strategy tailored to achieve an ideal resolution for his clients. Moreover, David has significant experience developing and implementing policies and procedures to mitigate risks and exposure to clients and ensure their compliance with all applicable laws and regulations.
David graduated from Cornell University, College of Arts and Sciences and received his Juris Doctorate from New York University School of Law. He began his career in Manhattan, and lives in Bedford, New York, with his wife and their two children.
REPRESENTATIVE MATTERS
- David successfully represented a prominent commercial real estate holder in multi-million-dollar actions to enforce the lease payment obligations of various big-box national retailers.
- David and his team replaced an AmLaw 100 firm three weeks before trial and successfully defended a multi-billion-dollar private equity firm against claims for fraudulent transfer in a $66 million action brought in the United States District Court for the Southern District of New York. The matter settled on the courthouse steps for a mere fraction of the alleged damages and on terms that were extremely favorable to the client.
- David successfully defended a large AmLaw 200 international law firm sued for legal malpractice in the United States District Court for the Southern District of New York. David and his team won partial dismissal with prejudice of the lawsuit and the matter subsequently settled on terms that were extremely favorable to the client.
- On behalf of one of the five largest investment banks in the United States, David conducted a large-scale and complex Rule 2004 investigation involving numerous financial institutions and individuals suspected of engaging in naked short selling.
- As counsel to a growing litigation finance firm, David regularly and extensively evaluated the merits of potential litigation finance investments for and advised the client on compliance with state laws and regulations.
